What is Title IX?

Title IX is a federal civil rights law that prohibits sex-based discrimination in education programs and activities. It states: "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

Title IX covers all aspects of education, including:

  • Academic programs and activities
  • Admissions and recruitment
  • Athletics and extracurricular activities
  • Employment and hiring practices
  • Sexual harassment and misconduct
  • Pregnancy and parental status

University Policy

Ludwitt Academy prohibits sexual harassment, sexual assault, dating violence, domestic violence, stalking, and any other form of sexual misconduct. This policy applies to all students, faculty, staff, and third parties in connection with university programs and activities.

The university is committed to providing prompt, fair, and impartial investigation and resolution of reports of sexual misconduct, while providing support and resources to all parties involved.

Prohibited Conduct

Sexual Harassment

Unwelcome conduct of a sexual nature that is severe, pervasive, and objectively offensive, including:

  • Unwelcome sexual advances or requests for sexual favors
  • Verbal or physical conduct of a sexual nature
  • Creating a hostile environment based on sex
  • Quid pro quo harassment (conditioning benefits on sexual conduct)

Sexual Assault

Any sexual act directed against another person without consent, including:

  • Rape and attempted rape
  • Sexual contact without consent
  • Incest and statutory rape
  • Any sexual act when the victim cannot consent

Dating and Domestic Violence

Violence committed by a person in a romantic or intimate relationship, including:

  • Physical, sexual, or psychological abuse
  • Threats of violence or intimidation
  • Controlling or coercive behavior
  • Economic abuse or isolation

Stalking

Engaging in a course of conduct directed at a specific person that would cause a reasonable person to fear for their safety, including:

  • Following or pursuing someone
  • Repeated unwanted contact or communication
  • Monitoring or surveillance
  • Cyberstalking or online harassment

Understanding Consent

Consent is informed, voluntary, and mutual agreement to participate in sexual activity.Consent must be ongoing throughout a sexual encounter and can be withdrawn at any time.

Key Points About Consent:

  • Consent cannot be given by someone who is incapacitated by alcohol, drugs, or other substances
  • Consent cannot be given by someone who is mentally incapacitated or physically helpless
  • Past consent does not imply future consent
  • Consent to one sexual act does not imply consent to other acts
  • Silence or lack of resistance does not constitute consent
  • Consent can be withdrawn at any time
